Terms of Service

These Terms of Service ("Terms") govern your use of Stackfolio ("the Service"), operated by T & H Negus Pty Ltd (ABN 57 651 444 147), an Australian company. The Service is available to users in both Australia and New Zealand via stackfolio.com.au and stackfolio.co.nz (which redirects to stackfolio.com.au). By creating an account or using the Service, you agree to these Terms.
1. About the Service
Stackfolio is a personal portfolio tracking and net worth management tool. It helps you organise, track, and visualise your financial assets, liabilities, and spending. The Service supports multiple currencies including AUD, NZD, and USD.
2. Eligibility
You must be at least 18 years of age and reside in Australia or New Zealand to use the Service. By creating an account, you represent that you meet these requirements. The Service is not available to users in other jurisdictions at this time.
3. Your Account
- ▸You are responsible for maintaining the security of your account credentials and two-factor authentication setup.
- ▸You must provide accurate information when creating your account and keep it up to date.
- ▸You are responsible for all activity that occurs under your account.
- ▸You must notify us immediately at support@stackfolio.com.au if you become aware of any unauthorised use of your account.
4. Subscriptions and Pricing
- ▸Stackfolio offers a free tier and paid subscription plans. Plan details and limits are displayed on the Upgrade page.
- ▸Prices are inclusive of GST where applicable (Australian GST or New Zealand GST, depending on your location).
- ▸Payments are processed securely by Stripe. We do not store your full payment card details.
- ▸Subscriptions renew automatically. You can cancel at any time from the Billing page, and your access continues until the end of the current billing period.
- ▸We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.
5. Your Data
- ▸Ownership: You retain ownership of all financial data you enter or upload to Stackfolio.
- ▸Export: You can export all your data at any time from Account Settings.
- ▸Deletion: When you delete your account, all data is permanently and irreversibly deleted from our systems.
- ▸Privacy: How we collect, use, and protect your data is described in our Privacy Policy.
6. Acceptable Use
You agree not to:
- ✕Use the Service for any unlawful purpose or in violation of any applicable law
- ✕Attempt to gain unauthorised access to the Service or other users' accounts
- ✕Upload malicious files, viruses, or code designed to interfere with the Service
- ✕Scrape, crawl, or use automated tools to extract data from the Service
- ✕Resell, sublicense, or commercially exploit the Service without our written consent
- ✕Enter financial data belonging to another person without their express consent
7. Accuracy of Information
The Service displays financial data based on information you provide and data from third-party sources (stock prices, metal prices, cryptocurrency prices, exchange rates). While we endeavour to keep this information accurate and up to date:
- ▸Market prices may be delayed (typically 15 minutes for stocks and metals).
- ▸Exchange rates are sourced from Yahoo Finance and may not reflect real-time rates.
- ▸Property valuations are based on your manual entries and do not represent professional appraisals.
- ▸We do not guarantee the accuracy, completeness, or timeliness of any financial data displayed.
8. AI-Powered Features
Stackfolio offers optional AI-powered transaction categorisation using Anthropic's Claude AI. This feature is opt-in and requires your explicit consent. AI-generated categories are suggestions only and may be inaccurate. You can review and correct all AI suggestions at any time. See our Privacy Policy (Section 5) for details on what data is sent to Anthropic.
9. Limitation of Liability
To the maximum extent permitted by law, Stackfolio and T & H Negus Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or financial loss arising from:
- ▸Your use of or inability to use the Service
- ▸Financial decisions made based on information displayed in the Service
- ▸Inaccurate market data, exchange rates, or calculated valuations
- ▸Interruptions to the Service, data loss, or security breaches beyond our reasonable control
Our total aggregate liability for any claims arising from or related to the Service is limited to the amount you have paid us in subscription fees in the 12 months preceding the claim.
10. Consumer Rights
Nothing in these Terms excludes, restricts, or modifies any consumer rights that cannot be excluded under applicable law:
- ▸Australia: You may have guarantees under the Australian Consumer Law (Competition and Consumer Act 2010). These Terms do not limit those guarantees.
- ▸New Zealand: You retain all rights under the Consumer Guarantees Act 1993 (NZ) and the Fair Trading Act 1986 (NZ). These Terms do not exclude or limit those rights.
11. Termination
- ▸By you: You can delete your account at any time from Account Settings. All your data will be permanently deleted.
- ▸By us: We may suspend or terminate your account if you breach these Terms, with reasonable notice where practicable. We will provide an opportunity to export your data before deletion unless the breach involves illegal activity.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tasmania, Australia. Any disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of Tasmania.
For New Zealand users: this choice of law does not deprive you of the protection of mandatory consumer protection provisions under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, to the extent those provisions cannot be excluded by agreement.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a notice within the application at least 30 days before the changes take effect. The "Last updated" date at the top indicates when the Terms were last revised. Continued use of the Service after changes constitutes acceptance of the updated Terms.
